Terms of Service
These Terms of Service ("Terms") form a legally binding agreement between you and SELFX, LLC ("SELFX," "we," "our," or "us") regarding your use of our websites, products, and services, including Carousel Clout available at app.carouselclout.com (collectively, the "Services").
1. Acceptance of Terms
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
2. Eligibility and Accounts
You represent that you are at least 18 years old (or the age of majority where you live) and can form a binding contract. You are responsible for maintaining account confidentiality and all activity occurring under your account.
3. Credit Packages and Payments
- Carousel Clout sells credit packages for one-time purchase only.
- Credit packages are not subscriptions and do not auto-renew.
- Users may purchase packages up to 800 credits per transaction (subject to change).
- Purchased credits are used to generate AI carousel images in the Services.
- Credits never expire.
Payments are processed by Stripe. We do not directly store full payment card numbers. By making a purchase, you also agree to applicable Stripe terms and policies.
4. User-Generated Content
You retain ownership of content you submit, upload, or create using the Services, including prompts, uploaded materials, generated images, and design outputs ("User Content"), subject to rights granted in these Terms.
You grant SELFX, LLC a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display User Content solely to provide, maintain, secure, improve, and support the Services, comply with legal obligations, and enforce these Terms.
You represent that you have all rights needed for User Content and that your use does not violate law, third-party rights, or these Terms.
5. Acceptable Use
You agree not to:
- Use the Services for illegal, fraudulent, abusive, or infringing activity.
- Upload or generate content that violates intellectual property, privacy, or publicity rights.
- Interfere with or disrupt the Services, bypass security, or attempt unauthorized access.
- Use bots, scraping, or automation in ways that harm service integrity or violate these Terms.
6. Intellectual Property
Except for User Content, all rights in the Services, including software, branding, text, graphics, and underlying technology, are owned by SELFX, LLC or its licensors and are protected by applicable intellectual property laws.
7. Service Availability and Changes
We may update, modify, suspend, or discontinue any part of the Services at any time. We do not guarantee uninterrupted or error-free service.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELFX, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELFX, LLC'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SELFX, LLC IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.
10. Indemnification
You agree to defend, indemnify, and hold harmless SELFX, LLC and its officers, members, employees, affiliates, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, User Content, or violation of these Terms or applicable law.
11. Termination
We may suspend or terminate your access to the Services at our discretion, including for suspected violations of these Terms. Sections that by their nature should survive termination will survive, including payment obligations, ownership, disclaimers, limitation of liability, indemnification, and dispute terms.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Louisiana and the United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services shall be resolved exclusively in state or federal courts located in Louisiana, and you consent to personal jurisdiction and venue in those courts.
13. Changes to These Terms
We may revise these Terms from time to time. Updated Terms will be posted with a revised effective date. Continued use of the Services after updates means you accept the revised Terms.
